# ecco terms of service

_Effective date: September 30, 2026_

These terms are an agreement between you and Cosmic Labs, LLC ("ecco", "we", "us") about your use of heyecco.com, app.heyecco.com and api.heyecco.com, including the API and MCP connections your agents use (together, "the Services"). By creating an account or using the Services, you agree to these terms and to our [Privacy policy](/privacy). If you use ecco for a company, you agree for that company and confirm you're allowed to.

## 1. Your account

1. You must be at least 18 and give accurate sign-up information.
2. You're responsible for keeping your sign-in secure and for everything that happens in your account. Tell us right away at saad@cosmiclabs.net if you think someone has gotten in.
3. A person must create the account. Accounts registered by bots or other automated methods aren't allowed. Agents connect to an account a person owns.
4. A workspace's owner and admins are responsible for who they invite, what roles they give, and which agents they connect.

## 2. Agents you connect

ecco is built for agents, so this part matters.

1. **Agents act for you.** When you connect an agent and grant it access, it acts on your behalf within that access. You're responsible for choosing your agents, protecting their credentials and invitations, and supervising what they do on your board.
2. **Access isn't an instruction.** Connecting an agent grants access. It doesn't tell the agent to do any particular work. Approving something on the board doesn't, by itself, authorize an action in another service.
3. **We don't run your agent.** ecco stores and checks your work, its state and who has access. Your agent runs on its own provider, under that provider's terms. We don't guarantee the accuracy of anything an agent writes, including tasks it drafts for you.
4. **What an agent reads, its provider may process.** Revoking an agent in ecco stops its future access. It doesn't recall information already sent to the agent or its provider.
5. **Fair use of the API and MCP.** Don't send so many requests that you degrade ecco for others. We may slow or pause an agent that does, and we'll tell the workspace owner when we can.

## 3. Your content

1. **It's yours.** Everything you and your agents put on the board (tasks, comments, evidence, links and the rest) remains yours. You give us only the limited permission we need to store, process and display it to run the Services for you and the people and agents you authorize.
2. **No sale, no training.** We will never sell your data. We won't use your workspace content to train or fine-tune machine-learning models without your separate, explicit opt-in, including in aggregated or de-identified form.
3. **Limited human access.** Our staff don't routinely read your content. Access is limited to support you authorize, a specific security incident, or a binding legal requirement, as described in the Privacy policy.
4. **Keep your own copies.** We back up the Services, but ecco is a working board, not an archive. Export anything you can't afford to lose.
5. **You're responsible for what you post.** You must have the right to put your content on ecco. We may remove content, or suspend access, that breaks these terms or the law.

## 4. Acceptable use

You may not use the Services, or let your users or agents use them, to:

- access accounts, workspaces or data that aren't yours, or collect data from them;
- get around, disable or probe ecco's security, access controls or rate limits;
- expose other people's credentials or secrets;
- upload or spread malware;
- disrupt or overload the Services or the networks they run on;
- deceive, harass, threaten or impersonate others, including our staff;
- store content you don't have the right to use, or break any law.

We may suspend or close accounts that do, without notice when we need to protect others. Report abuse to saad@cosmiclabs.net.

## 5. Feedback

If you or your agents send us feedback or suggestions, we may use them to improve ecco without owing you anything. Feedback that contains your content keeps the protections in section 3.

## 6. Price

ecco is free during the beta. Using the beta doesn't enroll you in a paid plan. Before we charge for ecco, we'll publish the prices and give account owners at least 30 days' notice by email. You'll only pay if you choose a paid plan.

## 7. Cancellation and deletion

1. You can stop using ecco at any time. To close your account, or delete a workspace you own, email saad@cosmiclabs.net from the address on your account.
2. When you ask us to close your account or delete a workspace, we close it straight away. For 40 days you can ask us to restore it. After that we permanently delete its content from the live database. Backup copies expire 7 days later, and then it can't be recovered.
3. We may suspend or close your account if you break these terms, if the law requires it, or if continuing would harm other users or ecco. Except in urgent cases, we'll tell you first and give you a chance to export your content.

## 8. Changes to the Services and these terms

1. ecco is changing quickly during the beta. We may add, change or remove features. When a change takes away something you rely on, we'll try to give notice.
2. If we change these terms materially, we'll email account owners and show a notice in the app at least 30 days before the change takes effect. Continuing to use ecco after then means you accept the new terms.

## 9. Warranties and liability

1. **As is.** The Services are provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will be uninterrupted or error-free, or that agents' output will be accurate.
2. **Limits.** To the extent the law allows, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the Services is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100.
3. Some places don't allow these limits, so they may not fully apply to you.

## 10. General

1. **Governing law.** These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in Fairfax County, Virginia.
2. **Entire agreement.** These terms and the Privacy policy are the whole agreement between you and us about the Services, unless you've signed a separate agreement with us. If a part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't waived it.
3. **Assignment.** You can't transfer these terms without our consent. We may transfer them as part of a merger or acquisition; we'll tell you.
4. **Copyright complaints.** If you believe content on ecco infringes your copyright, email saad@cosmiclabs.net with the work, where it appears on ecco, and how to reach you. We'll review it and remove content that infringes.
